
Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the piclog platform operated by Poths Solutions GmbH (“piclog”, “we”, “us”), Pfingstweidstrasse 94, 8005 Zürich, Switzerland. By creating an account or using piclog, you agree to these Terms.
1. The service
piclog is a hosted platform that lets you create and publish photo story blogs. We provide infrastructure, a web editor, and public blog hosting. We do not pre-screen content before it is published.
2. Acceptable use
You may use piclog to publish personal or commercial content, provided that your content complies with these Terms and all applicable law. You are responsible for everything you publish on piclog.
3. Prohibited content
The following content is strictly prohibited on piclog:
- Content that is illegal under Swiss law or the law of the jurisdiction where it is accessed
- Child sexual abuse material (CSAM) — we are required by law to report this to the relevant authorities and will do so immediately
- Content that infringes the intellectual property rights of any third party
- Defamatory, harassing, or threatening content directed at individuals
- Content that reveals private personal information of others without their consent (doxxing)
- Spam, phishing, or other deceptive content
- Malware, malicious code, or content designed to interfere with systems
4. Intellectual property
You retain all intellectual property rights to the content you publish on piclog. By publishing content, you grant us a non-exclusive, royalty-free licence to store, display, and deliver that content as part of operating the platform. We do not claim ownership of your photos or writing.
You must not publish content that infringes the rights of others. If you believe your copyright has been infringed, please contact us at piclog@poths-solutions.com.
5. Content reporting and removal (DSA)
piclog is a hosting service under the EU Digital Services Act (DSA). We do not pre-screen content before publication but we act promptly on valid reports.
Anyone may report content they believe to be illegal or to violate these Terms by using the “Report” link on any blog page, or by contacting us directly at piclog@poths-solutions.com. We review reports and, where a report is valid, remove the content and notify both the reporter and the blog operator. Our target review time is 72 hours.
6. Repeat-infringer policy
We maintain records of content removal actions. Accounts that repeatedly post content that violates these Terms or applicable law will be suspended or permanently terminated, at our discretion. We will notify the account holder before suspension unless immediate action is required to prevent serious harm.
7. Commercial blog operators
If you operate a commercial blog — for example, selling prints, promoting a brand, or providing professional services — you are acting as an independent data controller for your blog visitors' data and as a business operator under applicable law. You are solely responsible for:
- Providing your own imprint (Impressum) as required by Swiss and EU law
- Providing your own privacy policy for your blog visitors
- Complying with all applicable laws in your jurisdiction, including consumer protection and advertising law
piclog acts as a data processor on behalf of commercial blog operators and is not responsible for the content or legal compliance of individual blogs.
8. Account termination
You may delete your account at any time from the dashboard. We may suspend or terminate your account if you breach these Terms, with notice where reasonably possible. Upon termination, your blog and all associated content will be permanently deleted.
9. Liability limitation
piclog is provided “as is” without warranties of any kind. To the extent permitted by Swiss law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Changes to these Terms
We may update these Terms. We will notify you by email at least 14 days before material changes take effect. Continued use of piclog after the effective date constitutes acceptance of the updated Terms.
11. Governing law and jurisdiction
These Terms are governed by Swiss law. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Zürich, Switzerland.
